INFORMATION
Mr. Gosnell joined the firm as a shareholder in April
2004. He has
practiced general civil law for over 26 years. His areas of practice have focused
on real estate litigation and collections, primarily foreclosures
of real estate mortgages. In this practice, Mr. Gosnell has represented financial
institutions and other lenders on many issues related to lending practices and
lender liability. He is knowledgeable with respect to federal regulations relating
to lending, particularly with regard to Truth-In-Lending, and the Fair Debt Collection
Practices Act. Mr. Gosnell has tried cases in both state and federal courts in
matters including real estate, business litigation, lender liability, and personal
injury. He is thoroughly familiar with landlord/tenant relationships and represents
many landlords in eviction proceedings.
In addition to his litigation practice, Mr. Gosnell
has vast experience
representing creditors in bankruptcy, particularly in Chapter 7 and 13 cases.
His main area of expertise in this regard is in analyzing the feasibility of
a debtor's Chapter 13 Bankruptcy Plan and in obtaining termination from the
Bankruptcy Code's Automatic Stay provisions.
Another valuable aspect of Mr. Gosnell's legal experience
is his lengthy exposure to transactional real estate
work, particularly in the area of real estate closings
and drafting of leases. Mr. Gosnell has handled numerous
closings for both sellers and buyers, as well as lenders,
during his many years of legal practice.
Mr. Gosnell is a graduate of Indiana University and
earned his law degree at the University of Louisville
Brandeis School of Law. When
not practicing law, Mr. Gosnell is an avid competitive golfer who has competed
in state and national events. He has played in both the Kentucky State Amateur
and Kentucky State Open on several occasions, and in many other local tournaments.
He is the past club champion at several golf clubs. He also donates time serving
his church, The Church of Jesus Christ of the Latter-Day Saints. And, he is
a doting grandfather.
